2. Service Description

eGREETINGstore.com provides digital greeting card services that allow users to purchase and send digital greetings to recipients via SMS text message and email.

3. Pricing

Our service operates on a "pay what you want" model with a minimum price of $2.99 USD / £2.99 GBP per greeting card. Prices are available in US Dollars (USD) and British Pounds (GBP) depending on your selected country.

4. Greeting Card Access

Greeting cards are accessible via a unique link for 72 hours after first viewing. After this period, the link expires and the greeting will no longer be accessible.

5. Payment

All payments are processed through Stripe (for card payments, Apple Pay, and Google Pay) or PayPal (for PayPal balance and PayPal-routed cards). By making a purchase, you agree to the terms of service of whichever processor you use. We do not store your payment information.

6. SMS Messaging Terms and Consent

Our service uses SMS text messaging to deliver digital greeting cards to recipients. By using our service, you agree to the following SMS-related terms:

• Consent Requirement: By providing a recipient's phone number and checking the SMS consent checkbox during checkout, you represent and warrant that you have obtained prior express consent from the recipient to receive SMS messages on their behalf from eGREETINGstore.com.
• Message Content: The recipient will receive a single SMS message containing a personalized greeting notification and a unique link to view their digital greeting card.
• Message Frequency: Recipients will receive one (1) SMS message per greeting card purchased and sent to them. No recurring or marketing messages will be sent.
• Message and Data Rates: Standard message and data rates may apply to the recipient based on their mobile carrier plan. eGREETINGstore.com is not responsible for any charges incurred by the recipient.
• Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.
• Opt-Out: Recipients may opt out of future messages by visiting egreetingstore.com/sms-consent or contacting us at [email protected].
• Supported Carriers: SMS delivery is supported by most major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. International messaging may be subject to additional restrictions.

TCPA Compliance: In accordance with the Telephone Consumer Protection Act (TCPA), you agree that you will not provide phone numbers for which you do not have the legal authority to authorize SMS messages. Misuse of this service to send unsolicited messages is strictly prohibited and may result in account termination and legal action.

7. User Representations for SMS

By using our SMS delivery service, you represent and warrant that:

• You have a personal relationship with the recipient
• The recipient has provided you with their phone number voluntarily
• You have the recipient's consent to receive an SMS message about a gift from you
• The phone number you provide is accurate and belongs to the intended recipient
• You will not use this service to send messages to individuals who have not consented

8. Refunds

Due to the digital nature of our products, all sales are final. Please review your order carefully before completing your purchase.

9. User Conduct

You agree not to use our service for any unlawful purpose or to send inappropriate, offensive, or harassing messages to recipients. This includes but is not limited to:

• Sending messages to individuals who have not consented to receive them
• Using the service for commercial solicitation or advertising
• Sending threatening, abusive, or harassing content
• Violating any applicable local, state, national, or international law

10. Service Limitations

SMS delivery is provided on an "as-is" basis. While we strive for reliable delivery, we cannot guarantee that all messages will be delivered successfully. Factors such as carrier restrictions, incorrect phone numbers, or network issues may affect delivery.
